These Terms & Conditions ("Terms") govern your use of Choruku.Fit, owned and operated by Portal Nation LLC, located in San Jose, CA USA. By accessing or using Choruku.Fit, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

1. Use License & Permitted Use

Portal Nation LLC grants you a limited, non-exclusive, non-transferable license to use Choruku.Fit for your personal, non-commercial fitness planning, workout tracking, and progress monitoring.

You agree NOT to:

• Disrupt, damage, or interfere with the app or its servers
• Attempt to gain unauthorized access to the app or any user accounts
• Use the app for unlawful, harmful, abusive, or fraudulent purposes
• Reverse engineer, decompile, or attempt to derive the app's source code
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use automated tools, bots, or scrapers to collect data from the app

2. Critical Health & Medical Disclaimer

IMPORTANT: PLEASE READ CAREFULLY

Choruku.Fit is a fitness tracking tool and is NOT medical advice, medical treatment, or a substitute for professional medical guidance.

You must do the following before using any workout plan or fitness content:

• Consult Your Doctor: You MUST review every workout plan, exercise, and fitness recommendation in Choruku.Fit with a qualified healthcare professional (doctor, physical therapist, or certified fitness professional) BEFORE beginning any workout program
• Disclose Medical Conditions: If you have any pre-existing medical conditions, injuries, mobility issues, pregnancy, or health concerns, you must disclose these to your healthcare provider before using any content in this app
• Stop if You Experience Pain: If you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptoms during exercise, stop immediately and seek medical attention
• Individual Responsibility: Every person's fitness level, medical history, and body is different. Your doctor is the only qualified person to determine if a workout is safe and appropriate for you

Choruku.Fit makes NO claims that:

• Any workout plan will produce results
• Any exercise is safe for you specifically
• Any fitness content is appropriate for your body, fitness level, or medical condition
• We have verified the safety or efficacy of any workout plan or exercise

3. Limitation of Liability & Disclaimer of Warranties

Choruku.Fit is provided "AS IS" without warranties of any kind, express or implied.

Portal Nation LLC does NOT warrant that:

• The app will be uninterrupted, error-free, or always available
• Defects will be corrected
• The app is free from viruses, malware, or harmful components
• Workout data will be accurate or complete
• Any fitness results or progress will be achieved

Portal Nation LLC is NOT responsible for:

• Any injury, illness, pain, or health complications from using any workout plan or exercise in the app
• Any muscle strain, joint damage, cardiovascular issues, or any other physical harm
• Any mental health impacts or psychological effects from fitness content
• Any dietary, nutrition, or supplement recommendations (if any appear in the app)
• Any blog content, articles, tips, or educational materials in or linked to the app
• Any fitness tools, calculators, or features provided in the app
• Death or serious injury resulting from use of the app or any content within it

You assume full responsibility for:

• Your personal health, safety, and medical decisions
• Consulting qualified healthcare professionals before any workout
• Listening to your body and stopping if you experience pain or discomfort
• Your own fitness level and exercise capacity
• All consequences of using any content in Choruku.Fit

4. No Medical Advice

Nothing in Choruku.Fit constitutes medical advice, medical diagnosis, or medical treatment. Workout plans, exercise descriptions, fitness tips, and any other content are for informational purposes only and do NOT replace advice from a qualified healthcare professional.

If you have questions about whether a workout is safe for you, consult your doctor, not the app.

5. Accounts, Authentication & Google Security

Your Google Account & Data Security:

• You are responsible for maintaining the confidentiality of your Google Account login credentials
• You are solely responsible for all activities that occur under your Google Account while using Choruku.Fit
• You must keep your Google Account password secure and not share it with anyone
• If you use the Google Sheets integration, you are responsible for restricting access to your Google Drive and Google Sheets files. Do NOT share your Google files with unauthorized people
• Portal Nation LLC is NOT responsible for unauthorized access to your Google Account or Google files if you fail to secure them

Account Responsibility:

• You are responsible for managing permissions and access to connected services
• You may disconnect Choruku.Fit from your Google Account at any time through your Google Account settings
• Upon termination, your access to the app ends, but your data remains in your local storage or Google Drive

6. Limitation of Liability

To the fullest extent permitted by law:

Portal Nation LLC shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or opportunity
• Personal injury, illness, or death
• Business interruption or loss of business
• Any health-related claims or medical expenses

This applies even if Portal Nation LLC has been advised of the possibility of such damages.

Some jurisdictions do not allow exclusion of certain damages, so this limitation may not apply to you. In such cases, liability is limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify and hold harmless Portal Nation LLC, its officers, directors, employees, and agents from any claims, lawsuits, damages, or expenses (including legal fees) arising from:

• Your use of Choruku.Fit
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Any health injuries or medical issues resulting from your use of the app or any content within it
• Your failure to secure your Google Account or Google files

8. No Warranty of Results

Portal Nation LLC makes NO promises or guarantees regarding:

• Weight loss or body composition changes
• Muscle gain or strength increases
• Improved fitness or athletic performance
• Any other health or fitness outcomes

Your results depend on many factors beyond the app's control, including your effort, nutrition, genetics, sleep, and overall lifestyle. No app or workout plan can guarantee results.

9. Third-Party Services & Content

Google Services: Choruku.Fit uses Google OAuth, Google Sheets, and Google Drive. Your use of these services is governed by Google's Terms of Service and Google's Privacy Policy. Portal Nation LLC is not responsible for Google's practices or services.

External Links: Choruku.Fit may contain links to external websites, blogs, or resources. We are not responsible for the content, accuracy, or practices of third-party websites. Your use of external sites is at your own risk and governed by their terms.

10. Intellectual Property

All content in Choruku.Fit, including but not limited to text, graphics, logos, designs, workout plans, and code, are the exclusive property of Portal Nation LLC or its licensors. You may not reproduce, distribute, modify, or create derivative works without express written permission.

11. Privacy & Data

Your use of Choruku.Fit is governed by our Privacy Policy. Please review it to understand our data practices.

12. Modification of Terms

Portal Nation LLC may update these Terms at any time. Updated Terms will be posted on this page with the "Effective date" changed. Your continued use of the app after updates constitutes acceptance of the new Terms. If you do not agree to updated Terms, discontinue use of the app.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in California.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Portal Nation LLC regarding your use of Choruku.Fit and supersede all prior and contemporaneous agreements, understandings, and communications.
